Terms of Service for VEDA MenoMap IQ

1. Medical Disclaimer and No Doctor-Patient Relationship

• Educational and Tracking Purposes Only: VEDA MenoMap IQ provides personal symptom tracking, lifestyle logging, correlation calculators, and analytical tools (including Greene Climacteric Scale baselines and wearable biometric syncs). The Platform is intended solely for informational, organizational, and educational purposes.
• No Medical Practice or Clinical Advice: VEDA MenoMap IQ is not a medical provider, clinic, or licensed healthcare practice. Use of the Platform does not create a doctor-patient, therapist-patient, or other healthcare professional relationship between you and VEDA MenoMap IQ.
• Consult Your Physician: The Platform, including generated 1-Page Clinical Briefs, trend reports, and hormone titration logs, is designed to support—not replace—your direct, personal relationship with a qualified medical professional. Never disregard, avoid, or delay obtaining professional medical advice or treatment because of something you read or tracked on the Platform.
• Emergency Disclaimer: IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, SEVERE CHEST PAIN, ABNORMAL SUDDEN HEMORRHAGING, SEVERE DEPRESSION, OR THOUGHTS OF SELF-HARM, IMMEDIATELY CALL 911 (OR YOUR LOCAL EMERGENCY NUMBER) OR GO TO THE NEAREST EMERGENCY ROOM. DO NOT RELY ON VEDA MENOMAP IQ FOR URGENT HEALTH MATTERS.

2. Eligibility and Account Registration

• Age Requirements: The Platform is intended solely for individuals eighteen (18) years of age or older located within the United States. By registering, you warrant that you are at least 18 years old and possess the legal capacity to enter into these Terms.
• Account Security: You agree to provide accurate, current, and complete information during onboarding and profile setup. You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately at support@menomap.io of any unauthorized access or security breach.

3. Subscriptions, Free Trials, and Billing

• Subscription Tiers: Access to premium tracking tools, automated wearable correlations, the Doctor Brief PDF export, and full historical analytics may require an active paid subscription (e.g., Annual Plan billed at $59.99/year or Monthly Plan billed at $14.99/month).
• Free Trials: If you sign up for a 7-day free trial, you will receive full access to specified subscription features for the trial period. Unless canceled before the trial expires, your trial will automatically convert into a paid, recurring subscription, and your designated payment method will be charged the agreed rate.
• Automatic Renewal: Paid subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless canceled at least 24 hours prior to the renewal date. You authorize our third-party billing processor (e.g., Stripe) to charge your payment method on file.
• Cancellation and Refunds: You can cancel your subscription at any time via your in-app Settings menu ("Settings > Subscription & Billing") or through your mobile app store settings. Cancellations take effect at the conclusion of your current billing period; VEDA MenoMap IQ does not issue prorated refunds for partially used billing cycles, except where explicitly required by law.

4. Community ("Circle") Rules and User Conduct

The Platform includes interactive peer-to-peer community features ("Circle") where users can share experiences, ask questions, and offer peer support. By posting in the Community, you agree to adhere to the following standards:

• No Medical Prescriptions or Direct Medical Advice: You may share your personal health experiences, but you must not diagnose, prescribe dosages, or instruct other members on changing their prescription medications.
• Respectful and Safe Environment: Harassment, hate speech, body-shaming, discrimination, vulgarity, intimidation, or abuse of any kind will result in immediate suspension or permanent banning.
• No Commercial Solicitations or Spam: You may not market, advertise, solicit, promote multi-level marketing (MLM) products, or sell supplements, pharmaceuticals, or third-party services in the community.
• User-Generated Content License: By submitting text, comments, questions, or images to public community threads, you grant VEDA MenoMap IQ a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content within the Platform. You represent that you own or have the necessary rights to any content you post.
• Content Moderation: VEDA MenoMap IQ reserves the right, but does not assume the obligation, to monitor, review, flag, or remove any user-generated content that violates these Terms or our community standards.

5. Intellectual Property Rights

• Proprietary Technology: The Platform, including its code, software architecture, UI/UX designs, "VEDA MenoMap IQ" trademarks, logos, custom algorithms, scoring methodologies, and visual illustrations, is the exclusive property of VEDA MenoMap IQ and its licensors.
• Limited License: We grant you a personal, non-exclusive, non-transferable, revocable license to use the Platform strictly for your personal, non-commercial health management in accordance with these Terms. You may not reverse-engineer, decompile, duplicate, scrape, or distribute any portion of the Platform without our prior written consent.

6. Disclaimer of Warranties

• TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES LAW, THE PLATFORM AND ALL CONTENT, FEATURES, AND REPORTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
• VEDA MENOMAP IQ EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF SYMPTOM CORRELATIONS, RELIABILITY OF WEARABLE SENSOR DATA SYNCING, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PLATFORM WILL OPERATE UNINTERRUPTED, BUG-FREE, OR ERROR-FREE, OR THAT SYMPTOM-TO-TRIGGER CORRELATIONS WILL DETECT EVERY UNDERLYING MEDICAL CONDITION.

7. Limitation of Liability

• TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL VEDA MENOMAP IQ, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, WRONGFUL DIAGNOSIS, EMOTIONAL DISTRESS, LOSS OF DATA, OR LOSS OF USE ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE PLATFORM.
• IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF VEDA MENOMAP IQ EXCEED THE GREATER OF ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD) OR THE TOTAL AMOUNT YOU ACTUALLY PAID TO VEDA MENOMAP IQ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification

• You agree to defend, indemnify, and hold harmless VEDA MenoMap IQ and its officers, directors, employees, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your access to or use of the Platform; (b) any content you post in the Community; (c) your violation of these Terms; or (d) your reliance on any tracking data, clinical briefs, or content provided via the Platform in lieu of professional medical guidance.

9. Dispute Resolution, Mandatory Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

• Informal Resolution: Before initiating arbitration or legal proceedings, you and VEDA MenoMap IQ agree to attempt to resolve any dispute, claim, or controversy informally by contacting support@menomap.io.
• Binding Arbitration: If the dispute is not resolved within sixty (60) days, any unresolved controversy arising out of or relating to these Terms or the Platform will be determined by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.
• Waiver of Jury Trial and Class Actions: YOU AND VEDA MENOMAP IQ MUTUALLY AGREE THAT ALL CLAIMS MUST BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY.
• Governing Law: These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the United States and the state where the company is legally registered, without regard to conflict of law principles.

10. Termination

• We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without prior notice, if you violate these Terms, engage in fraud, or abuse other community members. You may terminate your account at any time by deleting your profile via "Settings > Delete Account."

11. Modifications to Terms

• VEDA MenoMap IQ reserves the right to modify or update these Terms at any time. If changes are material, we will notify you by posting an announcement in the in-app Messages center, sending an email, or updating the "Last Updated" date at the top of this document. Your continued use of the Platform following the effective date of revised Terms constitutes your acceptance.
